29 CFR 1926.501(b)(7)(ii): Each employee at the edge of a well, pit, shaft, or similar excavation 6 feet (1.8 m) or more in depth was not protected from falling by guardrail systems, fences, barricades, or covers:     a) On or about November 8, 2013, Chivas Contractors did not ensure that its employees were protected from fall hazards by guardrail systems, fences, barricades or covers. A Chivas Contractors employee was exposed to fall hazards of 11.5 feet while standing at the edge of an excavation where he was manually hoisting the spoils from the excavation up to the surface using a container tied to a rope.       Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:       a) On or about November 8, 2013, Chivas Contractors did not ensure that its employees were protected from cave-in hazards while working in a trench without adequate protective systems. A Chivas Contractors employee was exposed to cave-in hazards while locating and repairing a damaged water line in a trench 5 feet wide and 11.5 feet deep. 29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access:       a) On or about November 8, 2013, Chivas Contractors did not ensure that its employees were protected from fall hazards while using a portable ladder that did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access. A Chivas Contractors employee was exposed to fall hazards of 11.5 feet  while using a ladder to access a trench to locate and repair a damaged water line.
