OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) On or about December 17, 2013 and at times prior, employees were exposed to serious injuries while riding on a two-seater delivery van. A third person would ride in an unsecured bench with no passenger restraint in the middle section of the compartment of the van. Feasible and acceptable methods to correct this hazardous condition would be to install a seat and seat belt in accordance with the manufacturer's specification; provide a three-passenger delivery truck; have employees ride their own vehicles and pay for their mileage; or to have a policy that only two employees would ride in the delivery truck.
