OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to struck-by traffic hazards. On or about 12/16/2013, on Good Intent Rd., Deptford Twsp., employees of SOS Security were working as a sub-contractor for PSEG, conducting Flagging operations for a lane closure on a two-lane county controlled roadway. SOS Security flaggers were stopping and releasing traffic from both the east and west ends of the project and were exposed to potential vehicular struck by hazards. a) Employees were not trained on the appropriate flagger procedures. b) Employees were not provided with the appropriate STOP/SLOW paddles as a warning to oncoming vehicles. c) An employee was using hand movements alone to coordinate the flow of traffic. c) Employees were flagging from unsafe locations within the traveled lanes of the roadway. d) Flaggers did not have a clear line of site between flagger stations and were not provided with two way radios or other form of communication to coordinate the control of traffic. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUMBIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
