29 CFR 1910.1001(j)(3)(i): The building and facility owner did not determine the presence, location, and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the work site. The employers and building and facility owner did not exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of ACM and PACM.  Instance a) In the basement of building, constructed in 1895 according to the town Building Department, located at 284 Main Street Great Barrington, MA: On or about December 18, 2013, employees had potential exposure to two types of PACM that were not identified by the employer which is not in accordance with this subpart.  Instance b) In the basement of a building, constructed in 1900 according to the town Building Department, located at 4 Manville Street in Great Barrington, MA: On or about December 18, 2013, employees had potential exposure to two types of PACM that were not identified by the employer which is not in accordance with this subpart.

29 CFR 1910.1001(j)(7)(iv): The employer did not provide to all employees who perform housekeeping work in areas where ACM and/or PACM is present, an asbestos awareness training course covering the health effects of asbestos; and/or locations of ACM and/or recognition of ACM and PACM damage and deterioration and/or requirements in this standard related to housekeeping, and/or proper response to fiber release episodes:   (a) In the boiler room at 284 Main Street Great Barrington, MA: On or about December 30, 2013, a building custodian who accesses and occasionally cleans the boiler room had not received an asbestos awareness training course provided by the employer which is not in accordance with this subpart.
