Employees performing bricklaying activities on a two (2) story, approximate 3,200 square foot, single-family home, were working from a single 2"H x 10"W x12"L plank, on the 1st level of scaffolding approximately 8-1/2 feet above ground level. While the other employees were working below on the scaffold and ground where brick were stacked overhead. This practice created conditions which exposed employee(s) to falling from heights greater than 8 feet and 6 inches to the unfinished ground below.

29 CFR 1926.451(c)(2)(ii): Unstable objects were used to support scaffolds or platform units:  On or about December 18, 2013, at the jobsite on an inclined slope, the employer had placed the scaffold end frame without a base plate for the scaffold on the edge of a triangular piece of board. Scaffold end frames, which have no base plates, were erected on top of scrap wood. This practice created a condition which exposed employees to fall hazards greater than 8 feet to the unfinished ground below.
