29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    (a) Jobsite, 315 7th Avenue, Homestead, PA:  On or about 12/11/13 employees engaged in residential construction activities at heights ranging between 16 and 18 feet were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems.

29 CFR 1926.503(c)(3): Retraining was not conducted when inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.   Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part.   [59 FR 40738, Aug. 9, 1994; 60 FR 5131, Jan. 26, 1995]   (a) Jobsite, 315 7th Avenue, Homestead, PA:  On or about 12/11/13 the employer did not provide retraining on fall protection systems. Employees were working on an 8/12 pitch roof approximately 16-18 feet above lower levels and no fall protection systems were in place indicating the employees' failed to retain the skills and understanding necessary to prevent falls.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:   (a) Jobsite, 315 7th Avenue, Homestead, PA: On or about 12/11/13 the portable ladder used to access the upper work surface did not extend at least 3 feet above the upper landing.  Employees used this ladder to gain access and carry supplies to the work area.  The ladder was not secured in place to prevent movement nor was a grabrail installed to assist employees.
