OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while working under suspended loads:    a) stockyard, Yourga Trucking, Inc., 145 Yourga Place in Wheatland, PA.  On or about December 20, 2013, employees working inside open railcars during the loading of pipes by the knuckle boom loader were exposed to struck-by hazards of falling loads.

29 CFR 1910.178(l)(2)(ii): Training did not consist of a combination of formal instruction, practical training and evaluation of the operator's performance in the workplace:    a) warehouse and yard, Yourga Trucking, Inc., 145 Yourga Place in Wheatland, PA.  On or about December 20, 2013, forklift operator training consisted of on-the-job, practical training but did not include formal instruction.  Yard/Warehouse employees operate the forklifts daily to lift and move heavy loads.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not conducted at least once every three years:    a) warehouse and yard, Yourga Trucking, Inc., 145 Yourga Place in Wheatland, PA.  On or about December 20, 2013, the company had not conducted forklift operator evaluations prior to allowing employees to operator the fork trucks.  Yard/Warehouse employees operate the forklifts daily to lift and move heavy loads.
