OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from moving vehicles:  On or about December 22, 2013, employees were exposed to falls while riding on the tailgate of a moving 2004 Ford F150 pickup truck used to transport 50 lb. bags of chemical salt for a sidewalk salt crew operation.      Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1904.39(a): The employer failed to report to OSHA a work-related death within eight (8) hours after the death of the employee.    On or about December 23, 2013, Tovar Snow Professionals, Inc. did not report to OSHA the work-related death of a seasonal temporary agency employee working under the day-to-day supervision of Tovar.  The employee was working as a walk laborer in a sidewalk salt crew and incurred a fatal head injury when she fell from the tailgate of a moving pickup truck on December 22, 2013 during the salting operation.    There is no abatement certification or documentation required for this item.
