OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:     (a)  Sewer Solutions, 7669 Newton Street, Westminster, CO:  On or before 12-26-2012, the employer did not ensure employees were provided with and using high-visible apparel.  Condition exposed employees to struck-by hazards from motor vehicles while repairing the residential street with asphalt.       Abatement Note: Among other feasible and acceptable abatement methods to correct this hazard is to adopt the Federal Highway Administrations (FHWA) final rule (23 CFR Part 634) titled Worker Visibility Rule that states the following. All workers within the right-of-way of a Federal-aid highway who are exposed either to traffic (vehicles using the highway for purposes of travel) or to construction equipment within the work area shall wear high-visibility safety apparel. The preamble for this rule provides that "High visibility is one of the most prominent needs for workers who must perform tasks near moving vehicles or equipment."

(a)  Sewer Solutions, 7669 Newton Street, Westminster, CO:  On or before 12-26-2012, the employer had not ensured appropriate advance warning signs were in place (on each side of the project) to inform drivers that construction work is taking place or, what action a driver must take to drive through the work zone. Condition exposed employees to struck-by hazards from motor vehicles while repairing the residential street with asphalt.     Abatement Note: The Manual on Uniform Traffic Control Devices (MUTCD) standards figure 6H-18 titled Lane Closure on Minor Street (TA-18) illustrate the minimum sign and cone placement for this activity.
