29 CFR 1926.300(b)(4)(iii): Special handtools for placing and removing material were not such as to permit easy handling of material without the operator placing a hand in the danger zone. A.) Foulk Decorating Company dba Foulk's Flooring America, 2 East 3rd Avenue, Warren, PA 16365, on or about November 25, 2013 and times prior thereto: Employees were utilizing a DeWalt D24000 10" wet tile saw. While utilizing the saw, employees hands were placed/located within one inch of the diamond saw blade. The manufactures manual specifically warns against placing the hands 3-inches (76mm) or less from the blade.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: A.) Foulk Decorating Company dba Foulk's Flooring America, 2 East 3rd Avenue, Warren, PA 16365, on or about November 25, 2013 and times prior thereto: Employees were utilizing a DeWalt D24000 10" wet tile saw and had hand placement within one inch of the diamond saw blade. The employees utilizing the saw were not trained on the hand placement requirements set forth by the manufacturer.
