29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) RESERVE AT SPRING POINT, BUILDING D ROOFTOP - Employees installing shingles on the roof were not protected from falling, thereby exposing the employees to fall hazards ranging from approximately nineteen (19) feet to approximately thirty-eight (38) feet to the ground below, on or about December 30, 2013. (b) RESERVE AT SPRING POINT, BUILDING B, SECOND FLOOR - Employees worked on the second floor of the structure where no fall protection was being used to protect the exposed sections of the outer perimeter, thereby exposing employees to fall hazards of approximately eleven (11) feet to the ground below, on or about December 30, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) RESERVE AT SPRING POINT, BUILDING D - Employees used three (3) aluminum extension ladders to gain access to the roof, where the ladders did not extend a minimum of thirty-six (36) inches past the upper landing surface, thereby exposing employees to possible injury, on or about December 30, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
