29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a)  Worksite, 35 Halsey St. Bridgehampton NY - Employees were exposed to a fall hazard of approximately 18ft to the ground below, while installing plywood sheathing to the roof of a residential home; on or about 1/9/14.    b)  Worksite, 35 Halsey St. Bridgehampton NY - Employees were exposed to falling into a newly constructed pool opening, up to approximately 10ft; on or about 1/9/14.      Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Worksite, 35 Halsey St. Bridgehampton NY - Employees engaged in construction activities were walking and working at heights of up to 18ft above the ground.  The employees did not receive training to recognize fall hazards; on, or about 1/9/14.     Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
