29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:      a) On or about 1/13/14, outside of, and on the north side of apartment building under construction at 3056 Abbott Rd., Orchard Park, NY: An employee was installing vinyl siding while working from an Alum-A-Pole Scaffolding System, very similar to a Pump Jack Scaffold. The employee was exposed to a fall of 12 ft. from the east & west ends of the scaffold platform because no end rails or other fall protection was provided to prevent the employee from walking off the ends of the scaffold. Safety netting and a material platform was used as fall protection on the north side of the scaffold, however there was a gap in the netting of approx. 20 inches where the employee could fall through.       NO ABATEMENT CERTIFICATION REQUIRED

The east & west supporting poles were set in a "homemade" heavy duty wooden block mudsill/baseplate combination. These wood blocks were not level and rested on top of an icy ground surface.     NO ABATEMENT CERTIFICATION REQUIRED
