29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening. Employees performing maintenance and housekeeping duties were exposed to fall hazards in that the ladder openings were not protected for the following locations: a) Access to the upper platform on the south side of the south leg did not have fall protection. Employees were exposed to a fall hazard in excess of ten (10) feet from the upper level to the lower platform below. b) Access to the lower platform on the south side of the south leg did not have fall protection. Employees were exposed to a fall hazard in excess of ten (10) feet from the upper level to the lower platform below. c) Access to the second level of the interior of the feed mill not have fall protection. Employees were exposed to a fall hazard in excess of six (6) feet from the upper level to the lower platform below.

29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: Employees performing maintenance and housekeeping duties were exposed to fall hazards in that they were not provided with standard railings and/or conventional fall protection when working aloft in the following locations: a) Fall protection was not provided to employees while they were working aloft on top of the East Grain Bin and the West Grain Bin. Employees were exposed to a fall hazard in excess of fifteen (15) feet to the ground below. b) Fall protection was not provided to employees while they were working aloft on top of bin 99. Employees were exposed to a fall hazard in excess of twenty-five (25) feet to the ground below. c) The fall protection at the second level of the interior of the feed mill was inadequate in that a mid-rail was not instsalled. Employees were exposed to a fall hazard in excess of fifteen (15) feet to the concrete surface below.

Employees are exposed to a fall and other health hazards associted possible over exertion while climbing up to thirty-six feet within the ladder cage.

29 CFR 1910.272(g)(2): Whenever an employee enters a grain storage structure from a level at or above the level of the stored grain or grain products, or whenever an employee walks or stands on or in stored grain of a depth which poses an engulfment hazard, the employer shall equip the employee with a body harness with lifeline, or a boatswain's chair that meets the requirements of subpart D of this part. The lifeline shall be so positioned, and of sufficient length, to prevent the employee from sinking further than waist-deep in the grain. Employees performing maintenance and housekeeping duties within the west grain bin were exposed to engulfment hazards in that they were not provided with a body harness and lifeline. Employees were exposed to an engulfment hazard.
