29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.        A. Dave's Excavating, LLC worksite located on Allentown Rd., Lima, Ohio: On or about January 14, 2014, the employer did not ensure employees were protected from head injuries while working  near the excavator performing excavating activities. Due to this condition, employees were potentially exposed to impact injuries caused from falling material and/or equipment.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that was 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.       A. Dave's Excavating, LLC worksite located on Allentown Rd., Lima, Ohio: On or about January 14, 2014, the employer failed to ensure a safe means of egress such as a ladder was provided to employees installing a sanitary sewer line in a trench approximately 10.00 feet deep. The employee was entering/exiting the south end of the trench box.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:      A. Dave's Excavating, LLC worksite located on Allentown Rd., Lima, Ohio: On or about January 14, 2014,  the employer did not ensure an employee was adequately protected from cave-ins while installing a sanitary line in a trench approximately 10.00 feet. The employee was exposed to an unprotected near vertical wall while entering the unprotected south end of the trench.    Dave's Excavating, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652 which was contained in OSHA inspection number 313784308, citation number 1, item number 1 and was affirmed as a final order on October 13, 2010 with respect to a workplace located at Leipsic, Ohio.
