29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about January 23, 2014, at Eagan Manufacturing in Black Rock, Arkansas, employees involved in manufacturing window and door assemblies were exposed to struck by or caught-in hazards in the following instances: a) The metal shear, used for door panels, labeled #39, located in the door shop, had an unguarded opening greater than 1/4 of an inch. b) The Ryobi drill press, in the northwest corner of the door shop, used to assemble attic inlets, was not equipped with a chuck guard. c) The drill press nearest the north wall, in the northeast corner of the window shop, used to assemble door frames, was not equipped with a chuck guard. d) The second drill press from the north wall, in the northeast corner of the window shop, used to assemble window frames, was not equipped with a chuck guard. e) The third drill press from the north wall, in the northeast corner of the window shop, used to assemble window frames, was not equipped with a chuck guard.

29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch: On or about January 23, 2014, in the outside door area of the Eagan Manufacturing facility in Black Rock, Arkansas, where employees were required to operate a bench grinder, the grinder did not have an adjustable tongue guard and the distance from the top of the fixed safety guard to the abrasive wheel exceeded 1/4 of an inch. This created conditions which exposed the employee to the hazard of being struck by flying abrasive wheel particles.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: On or about January 23, 2014, at the Eagan Manufacturing facility in Black Rock, Arkansas, employees were performing maintenance and set ups on equipment such as but not limited to punch presses and shears, under lock out applications. The employer had performed a periodic review of the written procedures but the review had not included observation of the actual lock out applications to ensure the procedures were being followed.

Instance b) On or about January 23, 2014, in the window shop, of the Eagan Manufacturing facility, in Black Rock, Arkansas, where employees were manufacturing metal windows and frames, the breaker panels near the northeast corner of the building was not labeled with voltage, wattage, current, or other ratings.
