29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a.   An employee, assembling metal ventilation parts, was exposed to a noise dose of 105.7%, or an equivalent dBA (decibels A scale) of 90.4 dBA, which is capable of causing hearing loss. The noise sampling was conducted for 375 minutes during one work shift on February 3, 2014.  The employer did not provide an effective hearing conservation program, in that all employees were not provided a baseline audiogram within 6 months of their first exposure, nor were they informed of the purpose or requirements for wearing hearing protectors, the advantage, disadvantaged, and attenuation of various types, or instructions on the selection, fitting, use, and care of hearing protectors.
