OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and/or crushed-by hazards:      This violation occurred on January 19, 2014, and at times prior thereto, at the oil and gas well site, employees laying down tubing on a pulling unit, were using an elevator with unstable latch on the hook that came open and the pipe falling and striking an employee at the back of his head.

This violation occurred on January 19, 2014, and at times prior thereto, at the oil and gas well site, the employer did not conduct a  hazard assessment of the well site nor the rigging operations and equipment where employees were exposed to struck-by hazards.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wears protective helmet when working in areas where there is a potential for injury to the head from falling objects:         This violation occurred on January 19, 2014, and at times prior thereto, at the oil and gas well site, the employer did not ensure that employees working on the ground were protected from head injuries by enforcing the use of hard hats.
