Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards created by contact with the point of operation that were causing or were likely to cause death or serious physical harm to his employees: This violation was observed on or about February 5, 2015; where the unguarded foot-operated control to the CMF hydraulic press brake exposed employees to hazards causing or likely to cause amputations and/or broken bones.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. This violation occurred on or about February 5, 2014, when the employer did not establish a program consisting of energy control procedures including but not limited to employee training and periodic inspections.
