29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites:          a) On or about 2/10/14, in Banquet Room # 2, first floor, at the former FWS Furniture Store & Warehouse under renovation into apartments/commercial space, located at 1738 Elmwood Ave.,Buffalo, NY: A Triangle Engineering portable industrial fan was connected to 120 volt-ac power via a series of two extension cords, the first of which was a blue extension cord plugged into a receptacle of a 2- receptacle outlet box mounted on a column. No GFCI or assured equipment grounding program was being used.          NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:          a) On or about 2/10/14, in Banquet Room # 2, first floor, at the former FWS Furniture Store & Warehouse under renovation into apartments/commercial space, located at 1738 Elmwood Ave.,Buffalo, NY: A Triangle Engineering portable industrial fan was connected to 120 volt-ac power via a series of two extension cords, the first of which was a blue extension cord plugged into a receptacle of a 2- receptacle outlet box mounted on a column.  The plug on the power  cord of the fan lacked a ground prong.          NO ABATEMENT CERTIFICATION REQUIRED

The fan was neither identified as unsafe by tagging, rendered inoperable, nor was it physically removed from the jobsite.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used:     a) On or about 2/10/14, in Banquet Room # 2, first floor, at the former FWS Furniture Store & Warehouse under renovation into apartments/commercial space, located at 1738 Elmwood Ave.,Buffalo, NY: A Triangle Engineering portable industrial fan was connected to 120 volt-ac power via a series of two extension cords, the first of which was a blue extension cord plugged into a receptacle of a 2- receptacle outlet box mounted on a column. The outer sheath of the blue extension cord was badly frayed and crushed in spots, exposing the conductors.    NO ABATEMENT CERTIFICATION REQUIRED
