OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a forklift overturning or from the operator falling off the forklift, due to the operator not wearing the installed seat belt. a) On or about 12 February 2014 in the packing area: the employer exposed employees to crushing injuries by not enforicing the use of seatbelts when operating forklifts.
