OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a forklift overturning or from the operator falling off the forklift, due to the operator not wearing the installed seat belt.  a) On or about 12 February 2014 in the packing area:  the employer exposed employees to crushing injuries by not enforicing the use of seatbelts when operating forklifts.

29 CFR 1910.178(n)(6): Industrial truck drivers were not required to look in the direction of, and keep a clear view of the path of travel:  a) On or about 12 February 2014, in the packing area: The employer failed to ensure fork lift operators had a clear view of the path of travel in that operators were allowed to operate forward with the load they carried obstructing their view.
