29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed at the construction site on or about February 18, 2014 on the south side of roof where employee were exposed to a fall hazard of approximately 10 feet when performing roofing activities without a fall protection system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected from falling.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access. The employer does not ensure that the side rails of the ladder used by employees is extended at least 3 feet above the upper landing surface. This violation was observed at the construction site on or about February 18, 2014 where employees were exposed to a 10 foot fall while using an extension ladder to access a roof without extending the ladder's side rails at least three feet above the roof landing or securing the top of the ladder to the roof landing. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that ladders used by employees have the ladders side rails extended at least three feet above the roof landing, or securing the top of the ladder to the roof landing.
