29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about February 20, 2014 and at times prior thereto, an employee was exposed to a fall hazard of approximately 16 feet while applying fire resistant caulk to the upper exterior wall of the commercial building under construction.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: On or about February 20, 2014 and at times prior thereto an employee was exposed to a fall hazard of approximately 16 feet when the ladder the employee was using did not extend 3 feet or over the roof he was accessing.

29 CFR 1926.59: An employer engaged in construction activities did not comply with the requirements set forth in 29 CFR 1910.1200(g)(8): The employer did not ensure that material safety data sheets were readily accessible to the employees in their work area during each work shift: On or about February 20, 2014 and at times prior thereto, employees were exposed to the chemical hazard of 3M Fire Barrier Sealant CP 25WB which includes the chemicals: Polyoxyethylene monooctylphenyl ether, Di-2-ethylhexlphenyl phosphate, and Triphenyl phosphate while insulating and fireproofing a new construction building.
