29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail:  (a) Construction Site: On or about February 20, 2014, and at times prior, employees were exposed to a fall to the floor below using a stairway with approximately fifteen risers to access/egress the second story from/to the ground level to retrieve tools and material.  (b) Construction Site: On or about February 20, 2014, and at times prior, employees were exposed to a fall to the floor below using a stairway with approximately fourteen risers to access/egress the third story from/to the second level to retrieve tools and material.  (c) Construction Site: On or about February 20, 2014, and at times prior, as the controlling employer, Rotherham Construction, Inc. did not ensure its sub-contractor, Schafer Construction, Inc., protected their employees in that employees were exposed to a fall to the floor below using a stairway with approximately fifteen risers to access/egress the second story from/to the ground level to retrieve tools and material.  (d) Construction Site: On or about February 20, 2014, and at times prior, as the controlling employer, Rotherham Construction, Inc. did not ensure its sub-contractor, Schafer Construction, Inc., protected their employees in that employees were exposed to a fall to the floor below using a stairway with approximately fourteen risers to access/egress the second story from/to the ground level to retrieve tools and material.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such than the horizontal distance from the top support to the foot of the ladder way approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support):  (a) Construction Site: On or about February 20, 2014, and at times prior, as the controlling employer, Rotherham Construction, Inc. did not ensure its sub-contractor, Schafer Construction, Inc., protected their employees in that employees were exposed to a fall of up to approximately eleven feet to the ground below using a ladder to gain access to the second floor.
