29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a) University and S. 5th West, Bldg 6, Rexburg, ID: On or about February 13, 2014, two (2) employees were engaged in setting pump jack scaffold poles and did not don a personal fall arrest system while extended in a Snorkel aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d) provideds that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptatlbe and is regulated under 1926.502(e): Note: Abatement certification IS NOT required for this item.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. (a) On or about February 13, 2014, and at timse prior thereto, employees demonstrated inadequacies in their knowledge and ability to recognize the hazards associated with the type of scaffold in use and the essential need to don a personal fall arrest system.
