29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) The employer failed to provide documentation and certification for abatement of citation 1 item 2 in which ladders were used on surfaces which were not stable and level. Condition observed on or about 02/27/14.  b) The employer failed to provide documentation and certification for abatement of citation 1 item 3 in which ladders were not inspected by a competent person for visible defects on a periodic basis and after occurrence that could affect there safe use. Condition observed on or about 02/27/14.  c) The employer failed to provide documentation and certification for abatement of citation 1 item 4 in which the employer failed to immediately mark all materials such as portable ladders with structural defects or other faulty or defective components in a manner that readily identifies them as defective. Condition observed on or about 02/27/14.  d) The employer failed to provide documentation and certification for abatement of citation 1 item 5 in which employees using ladders were carrying objects or loads that could cause the employee to lose balance and fall. Conditions observed on or about 02/27/14.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such than the horizontal distance from the top support to the foot of the ladder way approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support):  a- 1901 Waverly Avenue, Long Beach Township NJ: Workers used aluminum extension ladders that were set up at approximately a 3:1 ratio.  As such the ladders were unstable making them prone to tipping over. As such employees were exposed to fall hazards in excess of 25 feet to the ground surface below.  Condition observed on or about 02/27/14.

29 CFR 1926.1053(b)(6): Ladders were used on surfaces which were not stable and level:  a- 1901 Waverly Avenue, Long Beach Township NJ: Workers used aluminum extension ladders, that were missing feet, set in loose sand, etc. to access work areas in excess of 25 feet above the ground surface below.  As such a ladder and its user fell to the ground below when it sank into the sand.  Condition observed on or about 02/27/14.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(15): Ladders were not inspected by a competent person for visible defects on a periodic basis and after an occurrence that could affect their safe use:  a- 1901 Waverly Avenue, Long Beach Township NJ: Workers used aluminum extension ladders to access the work areas in excess of 25 feet to the ground surface below.  Multiple rungs on the ladders were bent/damaged/replaced with pieces of wood, pull cords were missing, and some of the worksite extension ladders were missing feet.  As such, the damaged ladders exposed workers to fall hazards.  Condition observed on or about 02/27/14.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:  a- 1901 Waverly Avenue, Long Beach Township NJ:  Damaged aluminum extension ladders used by employees to access work areas in excess of 25 feet above ground level had not been tagged and removed from service. Multiple rungs on the ladders were bent/damaged/replaced with pieces of wood, pull ropes were missing, and some of the worksite extension ladders were missing feet. 29 CFR 1926.1053(b)(22): Employees  using ladders were carrying objects or loads that could cause the employee to lose balance and fall:  a- 1901 Waverly Avenue, Long Beach Township NJ: Workers carried pieces of 4 feet by 8 feet plywood sheets up aluminum extension ladders to install them to the exterior surfaces of a residential structure.  These employees carried the plywood sheets without any assistance.  As such these employees were exposed to fall hazards in excess of 25 feet above the ground surface below.  Condition noted on or about 02/27/14.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:  a- 1901 Waverly Avenue, Long Beach Township NJ: Workers used aluminum extension ladders to access the work areas in excess of 25 feet above the ground surface below.  These ladders contained bent/damaged rungs, were not set in/on firm foundation, not set at the proper 4:1 ratio, etc.  As such, the employees were exposed to fall hazards.  The company employees had NOT received any ladder hazard recognition training from the company.  Condition noted on or about 02/27/14.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
