29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system: a) At Carmike Cinemas East Side Opelika, Alabama: On or about March 4, 2014 and at times prior; the employer failed to ensure employees working from an elevated aerial lift basket were tied off exposing him to a fall hazard of 40 feet to the roof top below. b) At Carmike Cinemas West Side Opelika, Alabama: On or about March 4, 2014 and at times prior: the employer failed to ensure employees working from an elevated aerial lift basket were tied off exposing them to a fall hazard of 40 feet to the roof top below.

29 CFR 1926.501(b)(2)(ii): Each employee on a walking/working surface 6 feet (1.8 m) or more above a lower level where leading edges are under construction, but who was not engaged in the leading edge work, was not protected from falling by a guardrail system, safety net system, or personal fall arrest system.Note: If a guardrail system was chosen to provide the fall protection, and a controlled access zone had already been established for leading edge work, the control line may be used in lieu of a guardrail along the edge that parallels the leading edge: a) At Carmike Cinemas Opelika, Alabama: On or about March 4, 2014 and at times prior; the employer failed to ensure an employee working from a flat roof involved in window placement operations had fall protection in place exposing him to fall hazard of 12.2 feet to the ground below.
