OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees (a) Bravo Marble and Granite, Inc. - Employees were exposed to crushing injuries in the event of a turn-over, from operating a forklift (Mitsubishi Caterpillar forklift) without wearing a seatbelt, on or about March 7, 2014. Seat belts in the forklift truck are a component part of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a tipover accident, a hazard to which forklift trucks are particularly susceptible, and that the failure to wear the seat belt that is provided in the forklift truck increases the risk of injury to the operator in the event of such an accident. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1000(e): To achieve compliance with paragraphs (a) through (d) of this section, administrative or engineering controls were not determined and implemented whenever feasible: (a) Bravo Marble and Granite, Inc. - An employee cutting and grinding on granite countertops was exposed to respirable silica dust at an 8-hour Time Weighted Average (TWA) of 0.72 mg/M3, approximately 2.0 times the calculated permissible exposure limit (PEL) of 0.36 mg/M3, on or about March 13, 2014 without feasible engineering or administrative controls having been implemented. The exposure level was derived from two samples collected over an 85 minute period. Zero exposure was assumed for the unsampled time of 395 minutes. ABATEMENT NOTE: All proposed control measures shall be approved for each particular use by a competent industrial hygienist or other technically qualified person. Ninety (90) day progress reports are required during the abatement period. *STEP 1 Establish an effective respiratory protection program as an interim protective measure. *STEP 2 Submit to the Area Director a written, detailed plan of abatement outlining a schedule for the implementation of engineering and/or administrative measures to control employee exposure to hazardous substances as referenced in this citation. This plan shall include, at a minimum, target dates for the following actions which must be consistent with the abatement dates required by this citation: 1. Evaluation of engineering/administrative control options. 2. Selection of optimum control methods and completion of design. 3. Procurement, installation an operation of selected control measures; and 4. Testing and acceptance or modification/redesign of controls. *STEP 3 Abatement shall have been completed by the implementation of feasible engineering and/or administrative controls upon verification of their effectiveness in achieving compliance. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
