29 CFR 1910.132(c): Personal protective equipment was not of a safe design and construction for the work performed: a) During the period of October 6, 2013 through March 6, 2014, at the above located workplace, employees were required to work 10 feet or more above the floor using a body belt with a tether which was approximately eight feet long. The employer did not protect the employees by the use of an approved personal fall arrest systems. Employees were thereby exposed to the hazards associated with falls.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics was not provided to an operator that had been involved in an accident or near-miss incident: a) On or about November 19, 2013, at the above located workplace, a powered industrial truck operator was involved in an accident/incident. As of March 6, 2014, the operator who was required to operate powered industrial trucks had not received refresher training on the safe operation of powered industrial trucks after the accident/incident on November 19, 2013. Employees were thereby exposed to the hazards associated with powered industrial trucks. b) On or about January 17, 2014, at the above located workplace, a powered industrial truck operator was involved in an accident/incident. As of March 6, 2014, the operator who was required to operate powered industrial trucks had not received refresher training on the safe operation of powered industrial trucks after the accident/incident on January 17, 2014. Employees were thereby exposed to the hazards associated with powered industrial trucks.
