The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.1030(d)(2)(i): Engineering and work practice controls were not used to eliminate or minimize employees exposure:  a) Dr. Chenet P. Larose, D.M.D.: The employer used Darby Dental Supply Plastic Hub Dental Needles 30 Gauge Short (953-2360) to administer local anesthesia to patients. The Dental Assistant was exposed to bloodborne pathogens while dismantling the contaminated needles and syringes after the anesthesia was administered to patients. The employer did not evaluate and use commercially available and effective safer medical devices such as dental anesthetic needles with built-in safety features designed either to eliminate or to minimize the risk of accidental percutaneous injuries from contaminated needles. Observed on or about March 7, 2014   ABATEMENT NOTE: Abatement certification is required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.

Although the employer used needle recapping devices, the employer did not demonstrate that no alternative was feasible, exposing the dental assistant to bloodborne pathogens from potential purcutaneous injuries.
