29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): The employer does not protect employees from falling when working 6 feet or more above a lower level. This violation was observed on or about March 11, 2014, on the steep roof (slope 8 in 12) of a single family dwelling where an employee were exposed to a 15 foot fall hazard when installing a fireplace metal cap without a fall protection system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when exposed to falls 6 feet or more above a lower level.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer does not ensure that portable ladders rails are extended 3 feet above an upper landing surface. This violation was observed on or about March 11, 2014, on the steep roof (slope 8 in 12) of a single family dwelling where an employee were exposed to a 15 foot fall hazard when accessing the roof from a 24 foot extension without the ladder rails extended 3 feet above the upper landing. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that portable ladders used by employees to access an upper landing surface, and the ladder's length allows, the ladder rails are extended at least 3 feet above the upper landing surface.

This violation was observed on or about March 11, 2014, on the steep roof (slope 8 in 12) of a single family dwelling where an employee was exposed to an approximately 6-8 foot fall hazard when working from the top of a folded step ladder and also accessing the top of the fireplace with a closed 4 foot step ladder instead of using the step ladder to gain height for which it was designed. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that ladders are used for purposes for which they were designed.
