29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided:  The employer does not provide personal protective equipment. This violation was observed on or about March 13, 2014, at or near 20402 Canton Trace in Humble, TX, where employees were exposed to struck-by hazards when operating power tools and installing materials without eye, face, and head protection.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that protective equipment is provided for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, are provided.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates, mud sills or other adequate firm foundation:   The employer does not ensure scaffold poles bear on base plates, mud sills or other adequate firm foundation. This violation was observed on or about March 13, 2014, on the west side of a single family dwelling where employees were exposed to a 13 foot fall hazard when performing cornice work from pump jack scaffolding without the poles bearing on base plates, mud sills or other firm foundations.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that scaffold poles, legs, posts, frames, or uprights bear on base plates, mud sills or other adequate firm foundations.

The employer does not ensure scaffold are plumb and braced to prevent swaying and displacement. This violation was observed on or about March 13, 2014, on the west side of a single family dwelling where employees were exposed to a 13 foot fall hazard when performing cornice work from pump jack scaffolding without the poles being plumb and braced.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that scaffold poles, legs, posts, frames, or uprights are plumb and braced to prevent swaying and displacement.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold.   The employer does not protect employees from falling when working 10 feet or more above a lower level. This violation was observed on or about March 13, 2014, on the west side of a single family dwelling where employees were exposed to a 13 foot fall hazard when performing cornice work from pump jack scaffolding without a fall protection system.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee on a scaffold 10 feet or more above a lower level are protected from falling to a lower level.

Each pump jack bracket did not have two positive gripping mechanisms to prevent any failure or slippage.   The employer does not ensure that brackets, braces, and accessories are fabricated from metal plates and angles. This violation was observed on or about March 13, 2014, on the west side of a single family dwelling where employees were exposed to a 13 foot fall hazard when performing cornice work from pump jack scaffolding with upper braces that were fabricated from plywood material.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that pump jack brackets, braces, and accessories are fabricated from metal plates and angles.

This violation was observed on or about March 13, 2014, on the west side of a single family dwelling where employees were exposed to a 13 foot fall hazard when performing cornice work from pump jack scaffolding without being properly secured at the top, bottom, and other points as necessary.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that poles are secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary.
