29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer: (Construction Reference 1926.103(a)):  (a) Philo Insulation & Fireproofing Co. - The employer did not develop and implement a written respiratory protection program for employees who are required to wear full-faced and 3M half-masked respirators while spraying diphenylmethane diisocyanate (MDI), on or about March 14, 2014.   (b) Philo Insulation & Fireproofing Co. - The employer did not provide employee training as required by paragraph 1910.134(c)(1)(vii) to employees who were required to wear full-face, 3M half-mask respirators while spraying diphenylmethane diisocyanate (MDI), on or about March 14, 2014.   (c) Philo Insulation & Fireproofing Co. - The employer did not establish or implement procedures to ensure that respirators were cleaned, disinfected and stored in a sanitary manner as required by paragraph 1910.134(c)(1)(v) after spraying diphenylmethane diisocyanate (MDI), on or about March 14, 2014.  (d) Philo Insulation & Fireproofing Co. -The employer did not establish or implement procedures to ensure that employees were medically evaluated as required by paragraph 1910.134(c)(1)(ii) before using respirators for spraying diphenylmethane diisocyanate (MDI), on or about March 14, 2014.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103(a)):   (a) Philo Insulation $ Fireproofing, Co. - The employer did not provide a medical evaluation for employees who were required to wear a 3M half-mask respirator while spraying diphenylmethane diisocyanate (MDI) on the exterior of buildings, on or about March 14, 2014.      Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
