29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design:                                                                                   On or about March 13, 2014, employees worked in a scaffold platform that was not designed by a qualified person. The platform was supported by the forks, but the forks were not within the platform's fork pockets, nor was a locking pin used as specified by the Sky Trak manufacturer. The platform was secured to the forks by rubber ties and chains attached at the platform's guardrails. The excessive width caused the platform to be unstable.

29 CFR 1926.602(c)(1)(ii):  Modifications or additions which affected the capacity or safe operation of the equipment were made without the manufacturer's written approval:  On or about March 13, 2014, at a Hawthorne Suites hotel under construction, a personnel platform was used on the Sky Trak 10054 Telehandler, serial number 447027, without the manufacturer's permission, exposing employees of fall hazards exceeding 10 feet.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated to ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation.    On or about March 13, 2014, the employer failed to ensure that all forklift operators were certified, properly trained and evaluated in the operation of powered industrial trucks.
