29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:    (a)HV Ventures, LLC, dba Johns 4X4 Center @ 6367 Arapahoe Road, Boulder, CO 80303: On and before 3/9/2014, the employer did not develop, implement, and/or maintain a written hazard communication program. Employees are exposed to various shop-related chemicals/hazards including but not limited to brake fluids, degreasers, detergents, lubricants, metal cleaners, paints, fuels, solvents, and acetylene used for welding/cutting.     Abatement Note: The employer shall ensure a written Hazardous Communication Program is equipped with the following elements:     1. A list of the hazardous chemicals known to be present in the workplace;   2. Labels and/or other forms of warning secured to containers into which hazardous chemicals were transferred;   3. Material safety data sheets for each hazardous chemical utilized in the workplace; and4. Provide employees with effective information and training on hazardous chemicals in their work area on initial assignment and whenever a new physical or health hazards is about to be introduced.

Employees are exposed to various shop-related chemicals/hazards including but not limited to brake fluids, degreasers, detergents, lubricants, metal cleaners, paints, fuels, solvents, and acetylene used for welding/cutting.

29 CFR 1910.1200(h)(1): The employer did not ensure that employees were provided with effective information and training on hazardous chemicals that were present in the workplace at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area:    a) HV Ventures, LLC dba John's 4x4 Center @ 6367 Arapahoe Road, Boulder, CO 80303: On and before 3/19/2014, the employer did not provide employees with information regarding hazards associated with various chemicals and products used at the facility. Employees are exposed to various shop-related chemicals/hazards including but not limited to brake fluids, degreasers, detergents, lubricants, metal cleaners, paints, fuels, solvents, and acetylene used for welding/cutting.  Abatement Note: The employer shall ensure that employees are informed of the following, including but not limited to, information:   1. Any operations in their work area where hazardous chemicals are present; and  2. The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and material safety data sheets.  Abatement Note: The employer shall ensure that employees are trained on the following, including but not limited to, items  1. Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area;  2. The physical and health hazards of the chemicals in their work area;  3. The measures they can take to protect themselves from hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as work practices, emergency procedures, and personal protective equipment to be used; and  4. The details of the hazard communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information
