29 CFR 1910.178(n)(6): Industrial truck drivers were not required to look in the direction of, and keep a clear view of the path of travel:    a) 100 Mill Road, Freeport, NY (Worksite), Main Sales Floor, Aisle 14 - An employee operated a Crown counterbalance powered industrial truck (forklift), Model # RC5515-30 / Serial # 1A338789 / Unit # 8, and was not looking in the direction of travel, tines trailing, when he struck a 3rd party vendor's employee on, or about March 19, 2014.       Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1910.178(q)(7): Industrial trucks were being placed in services after the examination showed condition(s) adversely affecting the safety of the vehicle:    a) Worksite, Receiving Area - The Crown counterbalance powered industrial truck (forklift), Model # RC5515-30 / Serial # 1A337571 / Unit # 5, was operated with an inoperable amber strobe light safety device; and the forklift was not taken out of service until the necessary repairs could be performed on, or about March 19, 2014.    b) Worksite, Receiving Area - The Crown counterbalance powered industrial truck (forklift), Model # RC5515-30 / Serial # 1A390794 / Unit # 6, was operated with an inoperable amber strobe light safety device; and the forklift was not taken out of service until the necessary repairs could be performed on, or about March 19, 2014.    c) Worksite, Receiving Area - The Crown counterbalance powered industrial truck (forklift), Model # RC5515-30 / Serial # 1A338789 / Unit # 8, was operated with an inoperable amber strobe light safety device; and the forklift was not taken out of service until the necessary repairs could be performed on, or about March 19, 2014.       Note: Abatement for this violation was previously documented; therefore, the employer is not required to submit abatement certification or documentation for this violation in accordance with 29 CFR 1903.19.
