29 CFR 1910.178(l)(5): The employer did not evaluate the competency of the operator who had previously received training appropriate to the truck and working conditions encountered.      The employer hired employees that had received forklift training at a previous place of employment and the employer did not evaluate the employees to ensure they were competent to operate the truck safely including use of the Yale forklift that was equipped with a boom attachment.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:    Employees operating a Yale forklift, serial number 053617, in the shop and set-up areas were exposed to a forklift that was not in a safe operating condition due to the exhaust emissions containing greater than 2.0% carbon monoxide and the employer had not removed the lift from service.
