29 CFR 1910.132(f)(2): The employer did not require employees to demonstrate an understanding of the training specified in paragraph (f)(1) of this section, and the ability to use PPE properly, before being allowed to perform work requiring the use of PPE: (a) Exner's Basic Care, Inc. dba Roseadele, 1505 Third Street SE, Jamestown, ND 58401: On and before March 13, 2014, the employer did not require employees to demonstrate an understanding of when and what PPE was necessary. Employees understood that glove and eye protection were encouraged, but not required, when using products such as, but not limited to, bleach, Liquid Oxy Bleach II - a hydrogen peroxide solution, 16% chlorine bleach powder, and disinfectants. These products contain chemicals such as sodium dichloro-s-triazinetrione, dihydrate, sodium carbonate (soda ash), and various alcohols. This condition exposed employees to splash hazards to the skin and eyes.

29 CFR 1910.138(b): The employer did not base selection of appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the tasks to be performed, conditions present, duration of use, and the hazards and potential hazards identified: (a) Exner's Basic Care, Inc. dba Roseadele, 1505 Third Street SE, Jamestown, ND 58401: On and before March 13, 2014, the employer did not base the hand protection selected on an evaluation of the performance characteristics of the hand protection relative to the tasks performed and hazards identified. Employees were encouraged to use a food handler glove designed to be resistant to animal fats. Gloves that have chemical and liquid resistant properties for the specific chemicals used must be selected to assure appropriate skin and eye protection. This condition exposed employees to insufficient skin and eye protection when using products such as, but not limited to, bleach, Liquid Oxy Bleach II - a hydrogen peroxide solution, 16% chlorine bleach powder, and disinfectants.

These products contain chemicals such as, but not limited to, sodium dichloro-s-triazinetrione, dihydrate, sodium carbonate (soda ash), and various alcohols. Employees used products such as, but not limited to, bleach, Liquid Oxy Bleach II - a hydrogen peroxide solution, 16% chlorine bleach powder, and disinfectants. These products contain chemicals such as, but not limited to, sodium dichloro-s-triazinetrione, dihydrate, sodium carbonate (soda ash), and various alcohols. Some manufacturers were using the new SDS format as observed in the SDS three-ringed binder. This condition exposed employees to the hazard of not having the information they need to best protect themselves and to understand the new label and SDS format.
