29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  a.     On the Southwest Corner stairway where employees were accessing a scaffold platform, the employees climbed between the crossbraces 41 inches up to the outrigger thereby exposing employees to a fall hazard.

29 CFR 1926.451(g)(4)(iii): When midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent structural members are used, they shall be installed between the top edge of the guardrail system and the scaffold platform.  a.     On the second level where employees worked or gained access to the third level of the scaffold, the employer faided to provide or install a midrail thereby exposing employees to a 11 foot fall hazard.

29 CFR 1926.451(h)(2)(iii): Where tools, materials, or equipment are piled to a height higher than the top edge of the toeboard, paneling or screening extending from the toeboard or platform to the top of the guardrail shall be erected for a distance sufficient to protect employees below;   a.     In Area D of the gym where scaffolding was set up at the Southwest corner stairway, the employer stacked concrete block, equipment and tools above the toe boards thereby exposing employees working below to a contact hazard.

29 CFR 1926.1053(b)(9): The area around the top and bottom of ladders shall be kept clear.  a.     In Area D, Southwest Corner Stairway where employees accessed a scaffold from an extension ladder, the top of the ladder was blocked by rebar on the left side and scaffold brackts on the right side thereby exposing employees to a fall hazard.
