29 CFR 1926.20(b)(2): The employer did not ensure that frequent and regular inspections of the job sites, materials, and equipment were conducted by a competent person:  a) At the worksite where frequent and regular inspections of the job site were not performed by a competent person in that the designated competent person performing the frequent inspections did not know that employees working from open-sided floors more than six feet above a lower level, such as balconies, were required to be protected from falling by a fall protection system.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:    (a)  At the worksite where employees working on the ceiling rafters of the third floor were not protected by any type of a fall protection system.    (b) At the worksite where employees working on the second and third floors near wall openings were not protected by any type of a fall protection system.
