29 CFR 1926.453(a)(2):  The employer did not ensure that: Aerial lifts may be "field modified" for uses other than those intended by the manufacturer provided the modification has been certified in writing by the manufacturer or by any other equivalent entity, such as a nationally recognized testing laboratory, to be in conformity with all applicable provisions of ANSI A92.2-1969 and this section and to be at least as safe as the equipment was before modification.  (ref 29 CFR 1926.453(b)(2)(vii) concerning use of outriggers)    a) The employer modified the aerial lift support system by adding bottle jacks under each corner of the lift while the outriggers were extended. Employees were exposed to aerial lift tip-over hazard.  The jacks can interfere with the ability of the outriggers to widen the support base of the aerial lift; may also cause the load chart to no longer be accurate. The bottle jacks were not secured and can shift or tip over resulting in sudden shift of the weight distribution. 29 CFR 1926.453(b)(2)(ix):  Articulating boom and extensible boom platforms, primarily designed as personnel carriers, did not have both platform (upper) and lower controls. Upper controls shall be in or beside the platform within easy reach of the operator. Lower controls shall provide for overriding the upper controls. Controls shall be plainly marked as to their function.  Lower controls shall not be operated unless permission has been obtained from the employee in the lift, except in case of emergency.    a) The employer is using an aerial lift that does not have upper and lower controls; does not have controls in the lift basket.  All controls are below at ground level.  The employee who rides in the lift basket does not have the ability to avoid aerial lift hazards such as getting pinned against a structure, contacting  obstructions, contacting electric hazards.       b) The controls were not plainly marked. There was no red stop button.  A control labeled Boom has right and left arrows but also says UP and does not indicate whether it operates the cable that telescopes the boom in and out or the cable that derricks (hinges) the boom up and down. 29 CFR 1926.453(a)(1): The employer did not provide aerial lifts that comply with the following:   Unless otherwise provided in this section, aerial lifts acquired for use on or after January 22, 1973 shall be designed and constructed in conformance with the applicable requirements of the American National Standards for "Vehicle Mounted Elevating and Rotating Working Platforms," ANSI A92.2-1969, including appendix.  Aerial lifts acquired before January 22, 1973 which do not meet the requirements of ANSI A92.2-1969, may not be used after January 1, 1976, unless they have been modified so as to conform to the applicable design and construction requirements of ANSI A92.2-1969.  Aerial lifts include the following types of vehicle-mounted aerial devices used to elevate personnel to job-sites above ground:   (i) Extensible boom platforms;   (ii) Aerial ladders;  (iii) Articulating boom platforms;  (iv) Vertical towers; and  (v) A combination of any such devices.      a)  Employees were exposed to aerial lift boom free-fall hazard when operating the aerial lift which did not conform to the ANSI A92.2-1969 standard. The extensible (telescoping) boom retracted at fast speed when the cable that supports the boom became disconnected; descending 25 feet.        b)  The wire rope cable that extends the boom had extensive burring (broken wire strands) in a 5 ft long section above the base hoisting drum;  Ref ANSI A92.2-1969 appendix A: A1.6(2) which requires visual inspection of aerial lifts for evidence of defects.     Location: 151 East 28th Street, New York, N.Y. 10016      On or about 3/25/2014               Abatement note:  Currently available aerial lifts comply with ANSI A92.2-1969 with safety features designed to eliminate the hazard of boom collapse; such as double chains on chain operated lifts, and safety check valves on hydraulic lifts.       NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
