29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Southbridge Subdivision, Lot 886 - On or about March 21, 2014, employees installing roof sheathing were exposed to fall hazards up to approximately 22 feet onto earthen ground because the workers were not fall protected by conventional fall protection. b) Southbridge Subdivision, Lot 886 - On or about March 26, 2014, employees setting and/or bracing rafters for roofing systems were exposed to fall hazards up to approximately 10.5 feet onto the floor sheathing because the workers were not fall protected by conventional fall protection. ABATEMENT CERTIFICATION AND DOCUMENTATION IS REQUIRED

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) Southbridge Subdivision, Lot 886 - On or about March 26, 2014, and at times prior to, the employer did not ensure employees engaged in framing / rough carpentry and were regularly exposed to fall hazards up to approximately 22 feet were effectively trained to recognize the fall hazards encountered in their work. The employer lacked the knowledge to provide his employees with effective fall hazard recognition training in that that: 1. The employer was not aware that slide guards/toe boards could no longer be used as alternative procedures as described in Plain Language Revision of OSHA Instruction STD 3.1, Interim Fall Protection Compliance Guidelines for Residential Construction (Rescinded June 16, 2011; Extension of temporary enforcement measures expired on March 15, 2013). 2. Employees were not utilizing slide guards/toe boards correctly alternative fall protection measures as outlined in STD 3.1. 3. Employee interviews indicated that employees do not typically use any type of conventional fall protection for any type of framing activities in residential construction. 4. The foreman needed assistance in assessing the adequacy of fall protection components that he brought to the site (i.e. body belts versus body harnesses, requirement for safety latches/devices on ropes and lanyards, etc.). ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) Southbridge Subdivision, Lot 886 - On or about March 26, 2014, employees used an aluminum extension ladder to gain access to the second story of a residential home without the side rails of the ladder being extended at least 3 feet above the upper landing surface nor was the ladder secured at its top to a rigid support, exposing employees to fall hazards of up to approximately 14 feet, 4 inches onto earthen ground. ABATEMENT CERTIFICATION IS NOT REQUIRED
