Section 5 (a) (1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees rode in the elevated bucket of a John Deere Backhoe without fall protection.    On or about March 17, 2014, at an excavation site located on the corner of Broadway in Edmond, Oklahoma, an employee was allowed to ride and be elevated in the bucket of a John Deere Backhoe.  The employee was exposed to the hazard of falls and ejection from the bucket.
