29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: A.) Witherup Fabrication and Erection, Inc., 431 Kennerdell Road, Kennerdell, PA 16374, on or about March 28, 2014 and times prior thereto: Two employees accessed the top of a 16-feet tank to disconnect a mobile crane hook from the tank, and to secure the tank's spreader bar. The tank was not equipped with a standard guardrail system when preforming these tasks, and exposed to a 16-feet fall hazard. IN THE ALTERNATIVE: 29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: A.) Witherup Fabrication and Erection, Inc., 431 Kennerdell Road, Kennerdell, PA 16374, on or about March 27, 2014 and times prior thereto: Two employees accessed the top of a 16-feet tank to disconnect a mobile crane hook from the tank, and to secure the tank's spreader bar. Employees were not utilizing personal fall arrest systems when preforming these tasks, and exposed to a 16-feet fall hazard.

The lockout tagout procedures did not include specific information regarding the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy; a specific statement of the intended use of the procedure; specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy; specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them; and specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures.
