29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     Jobsite: On, or about, 03/21/2014 Employees were performing construction activities on the roof of residential structures and were not protected by a guardrail system, net system, or personal fall protection in the following instances:    House structure: Two employees were applying asphalt shingles to the porch roof and were exposed to a fall of approximately 10 feet.    Shed: An employee was applying asphalt shingles to the porch roof and was exposed to a fall of approximately nine feet.      The DePietro Roofing, Inc.was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 312346299, citation number 1, item number 2 and was affirmed as a final order on 07/08/2010, with respect to a workplace located at 657 Knotty Oak Road, Coventry, RI.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    Jobsite, Porch roof structure: Employees were using the Louisville portable extension ladder to access the porch roof whereby the ladder side rails did not extend a minimum of three (3) feet above the upper landing surface.       The DePietro Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926. 1053(b)(1), which was contained in OSHA inspection number 312342041, citation number 1, item number 3 and was affirmed as a final order on 06/10/2009, with respect to a workplace located at 672 Washington Street, Coventry, RI.
