29 CFR 1910.26(c)(2)(vii): Ladders having defects were not marked and taken out of service until repaired:   On or about April 01,2014, employee was exposed to fall hazards of 40 feet in height to the ground level below, when working from a Werner 40 foot extension ladder having three rungs bent and damaged, while trimming limbs off an oak tree.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    a. On or about April 01, 2014, employee was exposed to falls greater than 6 feet in height to the ground level below, when employee was resting on a tree branch without fall protection, while trimming the limbs off an oak tree.    b. On or about April 01, 2014, employee was exposed to struck-by hazards when working on ground level with no protective helmet, while employee worked overhead trimming branches off the oak tree.

29 CFR 1910.132(f)(1): The employer did not provide training to each employee who is required by this section to use personal protective equipment:   a. On or about April 01, 2014, employee was exposed to fall hazards greater than 6 feet in height to the ground level below, when not using fall protection while trimming limbs off an oak tree.     b. On or about April 01, 2014, employee was exposed to struck-by hazards from items such as but not limited to: tree limbs while not wearing protective hard hats while employees are working overhead.
