29 CFR 1926.62(d)(1)(i): Each employer who has a workplace or operation covered by this standard did not initially determine if any employee may be exposed to lead at or above the action level. On or about March 19. 2014, at the Iberville Demolition and Renovation Project, the employer failed to conduct a lead initial determination for those employees entering the asbestos containments.

29 CFR 1926.1101(d)(5): All general contractors on a construction project which includes work covered by this standard shall be deemed to exercise general supervisory authority over the work covered by this standard, even though the general contractor is not qualified to serve as the asbestos "competent person" as defined by paragraph (b) of this section. As supervisor of the entire project, the general contractor did not ascertain whether the asbestos contractor is was compliance with this standard, and did not require such contractor to come into compliance with this standard when necessary. On or about March 19, 2014, at the Iberville Demolition and Renovation Project, the general contractor (Durr Heavy Construction, LLC) failed to ensure that the asbestos contractor complied with the requirements of the decontamination area as addressed in 29 CFR 1926.1101(j)(1)(i).
