29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or permitted to use the respirator in the workplace: (Construction Reference 1926.103) (a) Worksite: A laborer permitted by his employer to wear a 3M half-face respirator while conducting demolition operations had not been provided a medical evaluation, on or about April 9, 2014. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (Construction Reference 1926.103) (a) Worksite The employer had not provided Respiratory Protection Appendix D information to a laborer permitted to wear a 3M half-face tightfitting respirator while conducting demolition operations, on or about April 9, 2014. (b) Worksite - The employer had not provided Respiratory Protection Appendix D information to laborers permitted to wear N95 filtering facepiece respirators while conducting demolition operations, on or about April 9, 2014. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
