29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that:    (a) At 85 S. Wacker Drive, Hartford, WI, an employee of PRL Excavation, Inc. was exposed to a cave-in hazard while taking grade measurements in an unprotected trench approximately 9 feet deep.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    (a) The ladder that an employee used for getting in and out of a trench did not extend at least 3 feet above the ground level. This exposed employees to a possible fall hazard of approximately 9 feet.
