OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:  a) Forks of Telehandler: On or about April 10, 2014, the employer allowed the use of a wooden pallet on the forks to elevate personnel which exposed an employee to falls up to 13-feet.

29 CFR 1926.502(d)(6)(i): A snaphook that was not designed for this connection was engaged directly to webbing:    a) Forks of Telehandler: On or about April 10, 2014, the employer allowed the snaphook of a personal fall arrest system to be attached back to the webbing portion of the lanyard which exposed the employee to a fall up to 13-feet to the ground below.
